Injunction releases gas company from paying environmental licensing fee
Judge Otavio Tioiti Tokuda of the 10th Tax Court released a gas company from paying another environmental licensing fee from the Environmental Company of the State of São Paulo (Cetesb). The decision was made on August 7th.
The writ of mandamus was filed against State Decree 62.973/2017, which amended the calculation of the environmental licensing fee and established new prices for issuing licenses. In order to measure the entire polluted area, Cetesb considered the company’s total area.
In granting the injunction, the judge found that there was “breach of the reasonableness and proportionality principles,” as license prices could increase by up to 1000%.
